SertifyMe — Terms of Service

1. Acceptance of these Terms

By creating an account, accessing or using SertifyMe (the Service), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. About SertifyMe (Beta)

SertifyMe is a web platform that lets users record work experience and have skills independently certified by peers. During this beta/soft‑launch phase:

  • Features may change or be withdrawn without notice.
  • The Service may be interrupted, insecure or contain errors.
  • Data loss is possible; maintain your own backups.

3. Eligibility & Accounts

You must be at least 18 years old (or the age of legal capacity in your jurisdiction) and use your real identity. You are responsible for all activity under your account and for keeping your credentials secure.

4. User Responsibilities

You must not:

  1. Post anything unlawful, misleading or infringing.
  2. Impersonate another person or falsely claim qualifications.
  3. Use the Service to harass, spam or engage in offensive conduct.
  4. Reverse‑engineer, scrape or commercially exploit the Service without written permission.

5. AI‑Assisted Verification Disclaimer

SertifyMe uses artificial‑intelligence models to provide an additional, probabilistic layer of verification only. AI outputs may be inaccurate or incomplete and should not be relied on as the sole basis for employment or contracting decisions.

6. Fees & Payment (if applicable)

The beta is currently free for personal use. We may introduce paid tiers later with at least 30 days' notice.

7. Australian Consumer Law (ACL) — Mandatory Statement

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion. 8. Intellectual Property

  • Your content: You retain ownership of content you submit. You grant SertifyMe a worldwide, non‑exclusive, royalty‑free licence to host and display it for the purpose of operating the Service.
  • Our content: We (or our licensors) own all code, branding and non‑user‑generated content. You receive a limited, revocable licence to use the Service as intended.

9. Privacy

We handle personal information in accordance with the Australian Privacy Principles. See our Privacy Policy for details.

10. Suspension & Termination

We may suspend or terminate your access immediately if you breach these Terms, harm other users or interfere with the operation of the Service. You may delete your account at any time.

11. Liability & Disclaimers

To the fullest extent permitted by law (and except for the consumer guarantees in section 7):

  • No warranties: The Service is provided “as is” and “as available”.
  • Limitation of liability: Our total aggregate liability for any claim arising out of or relating to the Service is limited to AUD $100 (or, if you have paid fees, the amount you paid us in the preceding 12 months).
  • No consequential loss: We are not liable for indirect or consequential loss, loss of profit, goodwill or data.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia. Before commencing court proceedings, you agree to email legal@sertifyme.com with a description of your dispute and allow 30 days for informal resolution. Courts of NSW have exclusive jurisdiction.

13. Changes to these Terms

We may update these Terms by posting a revised version and updating the “Last updated” date. Continued use after changes means you accept the revised Terms.
